On Friday, a three-judge panel of the Federal Court of Appeal unanimously upheld Judge Richard Mosley’s trial-division finding that the Trudeau government’s 2022 use of Emergencies Act powers was unlawful and unreasonable. There is not much point, I think, in plunging into the legal details of the new ruling. Mosley’s finding, which concluded with an open confession of disappointment in the wisdom of the Trudeau cabinet, seems to have been upheld on every single point that the federal justice department hoped to throw into doubt.
